Islamic supremacists are at war with freedom of speech in the West: The 57-government Organization of the Islamic Conference has been campaigning for years now at the United Nations to compel Western states to criminalize “religious hatred”—that is, honest discussions of how Islamic jihadists use Islamic texts and teachings to justify violence and to recruit peaceful Muslims to their cause. One little-noted weapon in this war is the courtroom: using libel and defamation laws as weapons to cow critics and intimidate them into silence. My courageous and indefatigable colleague Pamela Geller is the latest target.

Muslim foes of the freedom of speech have used this weapon frequently over the years. The Hamas-linked Council on American Islamic Relations (CAIR) has sued many, and has threatened legal action against many more. In 2006 CAIR dropped a $1.35 million libel suit against Andrew Whitehead of Anti-CAIR, who had called CAIR a “terrorist front organization,” after Whitehead’s lawyers asked probing questions about the group during the discovery process.

In another notable case, billionaire Saudi Khalid bin Mahfouz sued writer Rachel Ehrenfeld in libel-friendly Britain for writing in her book Funding Evil that he was involved in funding Hamas and al-Qaeda. Bin Mahfouz denied that he had knowingly given money to either. This case became the foundation for new laws protecting American writers from libel rulings in other countries.

I Was Fired for Telling the Truth

FOX News
October 21, 2010
By Juan Williams

Yesterday NPR fired me for telling the truth. The truth is that I worry when I am getting on an airplane and see people dressed in garb that identifies them first and foremost as Muslims.

This is not a bigoted statement. It is a statement of my feelings, my fears after the terrorist attacks of 9/11 by radical Muslims. In a debate with Bill O’Reilly I revealed my fears to set up the case for not making rash judgments about people of any faith. I pointed out that the Atlanta Olympic bomber -- as well as Timothy McVeigh and the people who protest against gay rights at military funerals -- are Christians but we journalists don’t identify them by their religion.

And I made it clear that all Americans have to be careful not to let fears lead to the violation of anyone’s constitutional rights, be it to build a mosque, carry the Koran or drive a New York cab without the fear of having your throat slashed. Bill and I argued after I said he has to take care in the way he talks about the 9/11 attacks so as not to provoke bigotry.

'Everybody Draw Mohammed Day' Cartoonist Molly Norris Goes Into Hiding After Radical Cleric's Fatwa "A soul that is so debased, as to enjoy the ridicule of the Messenger of Allah, the mercy to mankind; a soul that is so ungrateful towards its lord that it defames the Prophet of the religion Allah has chosen for his creation does not deserve life, does not deserve to breathe the air."

The cartoonist behind the recent "Everybody Draw Mohammed Day" cartoon has been drawn into hiding after a fatwa was issued for her death.

Molly Norris of the Seattle Weekly has gone into hiding on the recent advice of the FBI after being declared a "prime target" for death by extremist cleric Anwar al-Awlaki in a June issue of "Inspire," an English language magazine.

"The gifted artist is alive and well, thankfully," a Seattle Weekly reporter wrote Friday. "But on the insistence of top security specialists at the FBI, she is, as they put it, 'going ghost': moving, changing her name, and essentially wiping away her identity.

The SPEECH Act and the Islamic Agenda The Securing the Protection of our Enduring and Established Constitutional Heritage (SPEECH) Act of 2010: one step closer to stopping Lawfare Jihad in its tracks. “Considering Blair’s warning that Islamic ideology has penetrated ‘into even parts of mainstream opinion,’ investigative reporting is needed to expose the perpetrators, their means and the level of penetration...The SPEECH Act is the first bipartisan legislation that unanimously passed the 111th Congress. It was enacted to guarantee that the enemies of freedom fail to silence our free speech. The U.S. media is now free to resume its role in effort to foil further attacks on Americans at home and abroad and to prevent the growing threat of the Islamic agenda.”

Former British Prime Minister, Tony Blair, is no stranger to the Islamic agenda. As the Quartet's special envoy to the Middle East, his recent statement, "If these people could have killed 30,000 or 300,000 [on 9/11], they would have," should serve as a wakeup call. While Blair recognizes that "Islam's roots are deep, its tentacles are long,” he failed to mention the role that Britain's libel laws play in helping radical Muslims to shield their activities.

Soon after the attacks on the U.S. on 9/11, wealthy financiers of al Qaeda, especially from Saudi Arabia, began using Britain’s plaintiff-friendly libel laws and judges to muzzle the media from exposing national security threats, especially the names of al Qaeda’s financiers. Their lawfare have made London the Mecca of libel tourism, and England’s libel bar rich.

Their tactics were so effective that mere threat of suit is often enough to compel a pre-trial confidential settlement especially by American beleaguered researchers, investigators, journalists, publishers, bloggers and others, who deprived of their Constitutional free speech rights, wish to avoid steep legal costs and unjustified reputational ruin.

Libel tourism in the U.K. chilled the media’s commitment to shed light on matters of national security, depriving the public of important information and preventing critical debate. It causes investigative journalists and authors to stay away from reporting on terror financiers, and publishers to shun controversial subjects and authors.

MTA Caves: Ground Zero Bus Campaign Will Run “Mr. Mayor and your colleagues at the MTA and the Landmark Commission: New Yorkers will not forget 9-11 and we will not be cowed into submission or silence. You might not want to hear our voices, but the federal courts will require you to listen. You claim the mantle of the Constitution as a basis for supporting a Shariah-Islamist mosque at Ground Zero, yet the MTA—a government agency of the City—cavalierly denies “infidels” freedom of speech. Enough is enough.”

UPDATE: “The MTA has recognized the justice of our position in our lawsuit, and has agreed to run our ad as originally submitted.”

UPDATE: “The MTA has recognized the justice of our position in our lawsuit, and has agreed to run our ad as originally submitted.”

“This is a great victory for freedom of speech, and we are grateful to our attorneys David Yerushalmi and Robert Muise for mounting such an effective defense against politically correct censorship.”

Today we filed a lawsuit against the city of New York.

The city has refused to run my SIOA "Preservation of Ground Zero" bus campaign.

It seems that Mayor Bloomberg invokes certain freedoms when it serves his 2012 agenda. Doing away with term limits wasn't enough (which is why we are still suffering under his no-salt, no-transfat regime). He is now widening his ayatollah-like power grab to imposing blasphemy laws (Islamic sharia laws) on the secular marketplace. Bloomberg's frenzied Ground Zero mosque push may have inspired Al-Azhar clerics to oppose the Ground Zero Mosque, calling it a "a zionist plot."

Last month, I signed a contract with CBS Outdoor to run a "Preservation of Ground Zero" bus ad campaign. The campaign was paid for in full.

New Law Protects Free Speech from Foreign Courts The Securing the Protection of our Enduring and Established Constitutional Heritage or SPEECH Act, passed by both the House and Senate and awaiting President Obama’s signature, prevents lawsuits brought against American writers in foreign courts from limiting free speech in America. “It protects authors, journalists, and publishers by preventing U.S. federal courts from acknowledging or enforcing a judgment in a foreign libel suit that goes against the First Amendment... The bill also empowers authors and publishers to clear their names by showing that a foreign judgment is not in line with American law, even when the foreign plaintiff has not tried to enforce the judgment in the United States.”

A bill to protect authors, journalists, and publishers from “libel tourism” recently passed both houses of Congress. The bill, known as the SPEECH Act, prevents lawsuits brought against American writers in foreign courts from limiting free speech in America. The Securing the Protection of our Enduring and Established Constitutional Heritage or SPEECH Act passed the Senate and House in July.

Libel tourism refers to bringing a defamation lawsuit in a foreign country that is unrelated to the published material and where protection of free speech is weaker than in the United States. The goal is usually to silence or intimidate the journalist or author. Recent defamation lawsuits in the U.K. and Canada brought against American authors spurred legislators to take action.

Director of the American Center for Democracy Dr. Rachel Ehrenfeld, who documents and publishes terrorist organization’s funding sources, has been campaigning for protection from the judgments of foreign courts. After she exposed how Saudi billionaire Khalid bin Mahfouz funded al-Qaeda, Hamas, and other terrorist organizations in her 2003 book "Funding Evil: How Terrorism is Financed and How to Stop It," Mahfouz sued her for libel in London.

Free Speech: There's No Such Thing in Islam An excellent article breaking down the ways in which Shariah Law and Freedom of Speech are completely incompatible.

The concept of ‘freedom of speech’ is derived from the Capitalist ideology that is based on the belief that God and religion should be separated from life’s affairs (secularism). Human beings define how to live their lives free of the constraints of religion which is why freedom of individual, ownership, religion and speech are essential cornerstones of Capitalism. The right to speak and what are the limits of speech are therefore all defined by human beings.

This view completely contradicts Islam. In Islam it is the Creator of human beings Allah سبحانه وتعالى who gave the right of speech to people and defined the limits on what is acceptable and unacceptable speech.

Counter-Terrorism and Counter-Lawfare at the US Supreme Court The Supreme Court discusses lawfare jihad in relation to Holder v. Humanitarian Law. In the words of Chief Justice Roberts, “[i]t is wholly foreseeable that the PKK could use the “specific skill[s]” that plaintiffs propose to impart, §2339A(b)(2), as part of a broader strategy to promote terrorism...A foreign terrorist organization introduced to the structures of the international legal system might use the information to threaten, manipulate, and disrupt. This possibility is real, not remote.”

On June 21, 2010, the US Supreme Court handed down its decision in Holder v. Humanitarian Law Project, which reaffirmed the constitutionality of a key counter-terrorist statute that prohibits providing material support to foreign terrorist organizations. In this case, plaintiffs asserted that the statute in question, 18 U.S.C. § 2339A, unlawfully prevented them from providing material support to the Liberation Tigers of Tamil Eelam (LTTE) and Kurdistan Workers' Party (currently known as Kongra-Gel or PKK), both of which remain on the State Department’s Foreign Terrorist Organizations list.

Sir Elton John Defies Islamic Protest to Playing Morocco Shariah militants are working overtime to prevent Elton John, who is openly gay, from performing in Morocco. Mustapha Ramid of the Islamist PJD party said, "Morocco is an Islamic state where stages should not used to allow a person with such a degree of debauchery to perform, because we have to shield the young from such influences."

"Morocco is an Islamic state where stages should not used to allow a person with such a degree of debauchery to perform, because we have to shield the young from such influences." "Sir Elton John Faces Down Islamic Protest to Play Morocco," by Chris Mugan for Spinner, May 19:

Sir Elton John is to headline Morocco's largest music festival, despite calls from Islamist political parties that the government should deny him entry.

Opposition politicians argue the ivory-tinkling performer would harm the image of the North African kingdom should he be allowed to perform at the Mawazine World Rhythms Festival in the country's capital, Rabat.

]]> (Nick Holton) Shariah & Freedom of Speech/Lawfare Jihad Tue, 18 May 2010 00:00:00 +0000 Obama Bans Islam, Jihad from National Security Document Obama is mandating that terms like “Islamic extremism” and “jihad” are not used in national security documents. The administration is calling this diplomacy. Says Peter Feaver, a Duke University political scientist "’[Obama’s engagement effort] doesn't appear to have created much in the way of strategic benefit’ in the Middle East peace process or in negotiations over Iran's nuclear ambitions... Obama runs the political risk of seeming to adopt politically correct rhetoric abroad while appearing tone deaf on national security issues at home, Feaver said.”

Washington, D.C.

President Barack Obama's advisers will remove religious terms such as "Islamic extremism" from the central document outlining the U.S. national security strategy and will use the rewritten document to emphasize that the United States does not view Muslim nations through the lens of terror, counterterrorism officials said.

The change is a significant shift in the National Security Strategy, a document that previously outlined the Bush Doctrine of preventative war and currently states: "The struggle against militant Islamic radicalism is the great ideological conflict of the early years of the 21st century."

The officials described the changes on condition of anonymity because the document still was being written, and the White House would not discuss it. But rewriting the strategy document will be the latest example of Obama putting his stamp on U.S. foreign policy, like his promises to dismantle nuclear weapons and limit the situations in which they can be used.
